KEDUDUKAN FATWA DAN HASIL BAHTSUL MASAIL LINGKUP EKONOMI ISLAM

Abstract

In carrying out the teachings of the scope of Islamic economics, Islamic
economic practitioners will certainly need the fatwa of the National
Sharia Council-Majelis Ulama Indonesia (DSN-MUI) to ensure the
implementation of sharia principles. The purpose of writing this journal
is to find out how the position of the DSN-MUI fatwa has an important
role in the scope of Islamic economics. Although basically the fatwa itself
is an advice that can be implemented or can be ignored, but if the DSN
MUI Fatwa is associated with positive law, its position will be the same
as doctrine, namely as a reinforcement in the legal decision of a judge in
a case. Fatwa DSN-MUI also has the authority and important role in
making legislation that is binding, then used as positive law in
improving the development of Islamic economics in Indonesia. Thus, the
legal force of the DSN-MUI fatwa becomes binding in Islamic economic
operations.
