ANALAISIS HUKUM EKONOMI SYARIAH TERHADAP MEKANISME KOMISI AFFILIATE MARKETING PADA TIKTOK SHOP (STUDI KASUS PRODUK TIENS SYARIAH)
Abstract
The development of digital technology has changed the way people conduct buying and selling transactions, one of which is through the emergence of the affiliate marketing feature on the TikTok Shop platform. This feature allows someone to earn commissions by promoting and selling other parties' products. This thesis examines the mechanism of giving commissions to affiliates in Tiens Syariah product sales transactions, viewed from the perspective of Sharia Economic Law. This problem was raised because many parties still do not understand in depth what type of contract actually underlies the cooperative relationship between business actors and affiliates, so it is necessary to explore its compliance with applicable sharia principles. This study uses a qualitative research type with a case study design. Primary data was obtained through direct interviews with informants involved in the practice of affiliate marketing of Tiens Syariah products on TikTok Shop. The data was then supplemented with a search for supporting documents and a literature review relevant to the research topic. The results indicate that the affiliate marketing commission practice for Tiens Syariah products on TikTok Shop complies with DSN-MUI Fatwa Number 62/DSN-MUI/XII/2007 concerning the Ju'alah Contract. The relationship between the business actor (ja'il) and the affiliate (maj'ul lahu) is built on an agreement to provide remuneration when sales targets are achieved, in line with the basic principles of the ju'alah contract. The three essential elements of the ju'alah contract the party offering the reward, clearly defined work, and the agreed-upon remuneration are fulfilled in this practice. Therefore, the commission mechanism is deemed valid under Sharia law and does not conflict with the principles of muamalah.
